Yes it does. Points is points.  Problem is that you got the two-fer on the tickets.  You could battle one but not both. Take the two.  A one day safe driving class might get those point taken off, check with the DMV.

RT doesn't think "points is points". Frank Rossi, Esq  implied that non-speeding points don't get reported to insurance...that's what RT cares about.

RT's dilemma is...does he plead not guilty, drive 3 hours to podunk NY and risk having the judge say RT is SOL and it's back to 4 pts of speeding? ...or does he take the 2 pts non-moving violation?

I was pulled over doing 70 in a 55 in NC at around midnight - kids buckled and asleep, wife slumped over with some sort of dental malfunction - desperately trying to get to I-95 for a hotel room.

Cop unimpressed by my military credentials or ordination and unsympathetic to my wife's ailment.

Discussion among friends led me to dress in my Service Dress Blues, wife in prettiest dress, get certified copy of my driver's license, unblemished of course, copy of hotel receipt, and follow-on dentist's evaluation.

Enter Nash County Courthouse - something akin to the bar scene on "Star Wars" and we look comparatively normal and seem to have much in common with the ADA taking pleas.

We explain our circumstances and she allows us to plead to defective equipment -aka - a bad muffler.  Not a moving violation mind you.  Fine and court costs and we are outta there without any report to the big bad NJ DMV or insurance company who love to jack up rates, especially on speeding or accidents.

Moral of the story - get your ducks in a row, plot out your best strategy, wear your dress uniform and bring a hottie with you - that one especially helps if the ADA is male.

I feel for you - sometimes the cop has to make his quota depending on time of the month - it is a metric used to evaluate their vigilance or degree of anal retentiveness.

Get a lawyer, for ~$200-$300 (plus paying the fine) you can probably walk away with a non-moving violation and no points.  Your better off than getting the points and the insurance bump.

Refer back to my ticket. It's a non moving violation with points. So I'm trying to determine if this gets reported to insurance.

RT, usually any moving violation will go on your insurance (red lights, stop signs, lane violations, OUIs.)  The ones that dont are usually ones that dont effect your driving (inspection stickers, brake lights, headlights, honking your horn, registration violations etc)

How did the park guy estimate your speed?  Clocked, radar, lidar, estimated?  If only "estiimated" is checked off, then appeal it and you should get off easy.  If only "clocked" is checked, you have a 90% chance of getting off.  If that guy is just standing at the gate estimating cars, you should go after him.

If lidar or radar are checked off, you could always appeal and try to ask the cop if it is documented whether or not the radar/lidar are calibrated and whether or not the cop tuned it before his shift.

Was it a National Park Service cop or state policeman?  Im also assuming you have a right to a judges appeal.

Bottomline, its up to whether or not the judge is in the mood to waive tickets.  Thats all it is.

JU...my notice from the court says nothing about how he got the speed. The offer from the DA says RT can either take the moving violation at 4pts or a "failure to comly w/ flag person....2pts/non moving". If this doesnt impact insurance, RT would probably take it

Oh so did you have to send back the ticket that had that info on it?

Either way, you cant take the 4pt moving anyway right?  But you should always have a second appeal in front of a judge.  Id call you insurance agent to be sure.

RT will call the insurance agent on Mon. The ticket was sent back w/ the 'not guilty'. RT has the option to take the moving violation, take the non-moving one, or appear before a judge. The letter says the 2pt non moving is the DA's final offer. The issue is that the court is about 3 hrs away...RT is not thrilled to go do that if he doesnt have to.
