Wow, if that facility is half as impressive as it sounds, RPI is on to something.  Anyone feel that going this big could also mean the Engineers are considering a thought to jumping up to IAA in time??  Just a thought.

I hope this stadium makes the student population want to go to the games, instead of alumni filling the stands for Union/Hobart and it being empty otherwise...

Pep certainly was disappointed in the RPI fan turnout for the ECAC contest vs. the Saxons. Granted, it was 20 degrees out, but Pep would be willing to bet there were more Alfred fans in the stands. And, while it was a pathetic appearance for the AU Pep Band sans trumpet, the RPI Pep Band didn't stick around for the finish....and it was anybody's game! Pep hopes that changes with the new stadium...

Pep will admit that student attendance at AU football games is little or nothing today compared to yesteryear. However, it has been improving at AU and the Saxons have always had a pretty good following on the road, particularly at daytrip contests against Fisher, Ithaca, Hobart and Rochester.

...and here comes Michael Vick out of the can. I heard he gave a press conference this afternoon where he apologized for his crime. While apologizing a reporter asked Michael if the chain he was weraing around his neck was meaningful. Michael replied, "This old thing? **** This is my lucky dog paw. I wear it as a big **** you to everyone because I am going to be playing football again in four months. Oh yeah as I was saying I am so sorry..."

Its funny you mention this.  I had a friend that went into this computer business with his brother and basically the two ended up getting into this huge fight and the other brother left the business and totally destroyed my friend by stealing clients, lying, sabatoging his old website etc.......it was messy.  The fact that they were brothers didn't help much either!

Be careful. NCD's can be thrown out in court.  A person cannot be denied the able to work in his/her field.  If a guy sells widgets.  A company cannot prevent that person from selling widgets for another company.

Approach it from trade secrets, assets angle.  I'm not a lawyer.  But I got an NCD voided.  About 10 years ago, a company tried to prevent me from being a computer consultant within 2,500 miles of my former employer.  I got a consulting gig across the street.  Then all hell broke loose.

And some states don't honor them at all.  Its also good for small businesses where you don't want a former employee "stealing" company property (client lists) and/or using the old business product under a new name.  This is what happend to my friend.  His brother started badmouthing him to all the old clients and he basically had the same product but lowered the price.  Getting the clients was the hard part, and once the other brother learned the know-how, he just left with all the clients.

Its a tough situation all around that your probably better off with a lawyer if its a big decision

I'm actually on the otherside.  I need to do what you did, JT... void it.  I know for a fact CA doesn't allow them... but is it worth establishing residency there??  I'm not thinking so. 

I would think with economy and wanting to stay in the widget industry now -- that should be enough.  But those damn trade secrets.... probably would cost me 50 large (thats been the settlement amount, thusfar).

SJFF82, Esq. says they are perfectly enforceable in NYS provided that each party received something of value in exchange for the agreement and provided that it is reasonable in the geographical area it covers and the time that it is in effect.  Each case is different depending on the parties and the type of work involved.

Are these "secrets" commonly used by competitors?

Try to find an employment law specialist.  Someone who has broken these before.
