Baseball is the only sport with an explicit, Congressionally enacted, anti-trust exemption that says they can conspire together.

The other major sports, however, have always taken the position that they are a "single entity."  Basically, they argue that the NFL is one entity with 32 subsidiaries, not 32 competitive businesses.  The issue has come up before a few District Courts but all parties involved (leagues, teams and outside entities that deal with them) were all too afraid to challenge it before higher courts out of fear of creating bad law one way or the other.

Goodell changed that strategy.  Sometime next month the Supreme Court is set to hear this issue.  The case arose out of a merchandising dispute.  The Bears gave a merchandise license to a small-potatoes local company and the NFL sued that company because the NFL had given Reebok exclusive rights to its gear.  

If the Court decides the NFL is a single entity (and veteran Court observers think Sotomayor gives them the votes to come out this way based on her opinion in the MLB strike), get ready for pro sports as you know them to change.

Doesn't the fact that all teams share in merchandising and TV revenue, make the subsidiary argument?  Or since the Bears are a franchisee, they have to use the licensees that the franchisor (NFL) tells them to.  Kinda like how McDonald's contractually obligates franchisees to buy certain potatoes, buns, etc.,

Sharing revenue isn't relevant to the single-entity question.  I am not an anti-trust lawyer but, best I can tell, the question amounts to control of operations.

The merchandiser is basically arguing that the Bear's decision to allow the NFL to sell its license to Reebok doesn't also prohibit the Bears from selling a license to the merchandiser.  The term "franchise" is sports is more colloquial than legal.  It is different than the business arrangement between McDonalds and its franchisees.

Thanks for reminding JT, just took Cincy -2 over So. Fla.

I'll be there tonight.  This might be the year USF finally gets over the Cincy hump.  Plus, Tampa native EA is in the house.

USF is my only hope at not watching two losses in RayJay this weekend.

Not a chance, homie.  Tony Pike will be too much tonight... and Gilyard will return a kick for a TD..   SF will be in a bar downtown Cincy celebrating.  These are the two best Big East teams.. a win here is really great.

I love Cincy -2 in this one.  Whats the o/u ??



EDIT:  SF is impressed with how far USF has come under Leavitt.  SF remembers preparing to play Kentucky Wesleyan in 1998 and watching their game (they got murdered at the Old Sombrero) with USF ---- and thinking, "who are these guys??"

I gotta tell you, I could really care less about USF Football.

But I also recognize that we just do thins better here in Dixie.  Specifically, we make better athletes and football players.
